SAN FRANCISCO--Aug. 28, 2001 - American Le Mans Series Driver, Jennifer Tumminelli(www.jennifertumminelli.com) and The Louderback Law Firm, a San Francisco civil and employment trial firm, today announced they have filed a $6 million breach of contract lawsuit in San Francisco's Superior Civil Court against former race sponsor, Scient Corporation (NASDAQ: SCNT), an e-business consulting and professional services firm.
The lawsuit alleges Scient executives agreed to continue their 1999 title race sponsorship of Tumminelli in 2000, for $750,000. Specifically, in 2000, Scient, and its President and COO, Stephen Mucchetti, breached the contract after paying just $250,000. The suit claims damages for breach of contract, breach of covenant of good faith and fair dealing, intentional interference with contractual relationship, tortious interference with prospective economic advantage, and failure to pay race expenses incurred.
"Scient's decision to not fulfill their contractual agreement to sponsor Ms. Tumminelli in the race series has had a tremendous negative impact on her life" stated Charles Louderback, Attorney representing Ms. Tumminelli. "Prior to Scient's breach of contract, Ms. Tumminelli was a premier professional racecar driver. With the sudden withdrawal of Scient's financial commitment, Ms. Tumminelli has been forced to protect herself from several legal actions against her, while carrying a heavy financial burden to those, including herself, when Scient did not pay."
Tumminelli, 36, a Tiburon, California resident, is a single mother of a 15-year old daughter. Her professional racing achievements include competing as the only female among 60-drivers in the nationally televised American Le Mans Series in a 2001 Porsche 911 GT3R, the inaugural pole-sitter for the Women's Global GT Series, and one of 12 drivers on the CART Series - PPG Pace Car Team. Her achievements have been the focus of numerous TV and newspapers including Oprah, KPIX Evening Magazine TV show, Oxygen TV, Car & Driver Magazine and a Cadillac Catera print ad.
