Adding even more credence to the notion that the 23XI Racing and Front Row Motorsports v NASCAR antitrust lawsuit and countersuit is destined to trial was Denny Hamlin in how he characterized settlement mediation over the past week.
“It went okay the first day, not great the second day,” Hamlin said during a press conference on Saturday at Martinsville Speedway. “I don’t know. Didn’t end in any resolution, unfortunately.”
NASCAR motioned the court for a new round of mediation settlement in the court. The teams responded that they wanted to continue any settlement talks with the previously agreed upon mediator. NASCAR granted the motion but allowed mediator Jeffrey Mishkin to continue in that role.
This time, the conversations took place in the court room with Judge Kenneth D. Bell present.
What is to prevent this reaching trial?
“Just days in the week, that's it” Hamlin said.
There was also a court session on Thursday for oral arguments over a pair of summary judgment motions.
"Both sides probably feel strong about their case. You sat in the court and heard the arguments. I’ll let you come up with your own opinion, but I think one of us is on a suicide mission."
